Tammj Inc. (“Tammj”, “we”, or “us”) provides an online car-sharing platform connecting vehicle owners with travelers and locals seeking to book vehicles. Tammj is accessible online at tammj.com and as a mobile application. Collectively, the Tammj websites, blog, mobile applications, and associated services are referred to as the “Services”. By accessing or using the Services, including communicating with us or other Tammj users, you agree to comply with and be legally bound by these Terms of Service (“Terms”), whether or not you become a registered user. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and Tammj.

These Terms, along with the cancellation policy, nondiscrimination policy, applicable insurance terms, roadside assistance terms, and other relevant policies (collectively, the “Policies”), form the “Agreement” between you and Tammj (each a “Party” and together, “the Parties”). Tammj also provides a Car Sharing Agreement summarizing the terms of each reservation, accessible in the Services for any booked or previous trips, which can be used as proof of a reservation.

Modification of Terms

Tammj reserves the right, at our sole discretion, to modify the Services or this Agreement, including these Terms, at any time. Modifications will be posted on the Services, and the “Last Revised” date will be updated. By continuing to access or use the Services after a modification has been posted, you indicate agreement to the modified terms. If the modified terms are not acceptable, your sole recourse is to stop using the Services and close your Tammj Account within 30 days. If you continue to use the Services during the 30-day period, the modified Terms will apply.

Eligibility, Registration, and Verification

Eligibility

The Services are intended for:

• Guests: Travelers or locals meeting the eligibility requirements of the location where the vehicle is booked.
• Hosts: Vehicle owners aged 21 or older (or 18+ in specific regions like the United Kingdom and France).
  Any use of the Services by ineligible individuals is strictly prohibited.

Registration

To access certain features, you must create a Tammj Account. Registration involves providing your:

• Full name
• Email address
• Mobile phone number
• Password
  Alternatively, you may sign up using a third-party account (e.g., Apple, Google). Additional information is required for:
• Guests: Personal details relevant to bookings.
• Hosts: Details about you and your vehicle(s).

You must provide accurate, current, and complete information during registration, booking, or listing. Keep your account information up to date. Tammj may impose additional requirements, such as deposits, additional forms of payment, or protection plans.

Verification

Tammj reserves the right to perform identity and background checks, including driving history and vehicle details, using third-party services. These checks are not mandatory and do not imply endorsements. Hosts are responsible for ensuring their vehicles meet all legal and safety requirements, including proper registration, clean titles, and compliance with recall standards.

Consumer Report Authorization

By booking or listing a vehicle, or in cases of heightened account risk, you authorize Tammj to:

• Obtain auto insurance scores, credit reports, and background checks (including criminal records where applicable).
  For UK bookings, Tammj uses GB Group (GBG) to retrieve driver record information from the Driver and Vehicle Licensing Agency (DVLA). This authorization remains valid for three years from your first booking.

Fees and Taxes

Fees

Fees are itemized during checkout for guests. Hosts can view earnings in the Host Hub. By providing a payment method, you authorize Tammj or its third-party processors to store payment credentials and use them for balances, including trip costs, fees, and penalties. Payment credentials may be updated automatically by card networks, where applicable.

Collection of Fees

Tammj may employ collection agencies or legal counsel for overdue amounts. Late payments or chargebacks may incur additional fees and affect your credit score. To dispute credit reporting, contact help.tammj.com.

Taxes

Tammj may collect and remit taxes based on applicable laws, including marketplace regulations. Tax amounts are displayed in trip-related documents. Hosts are prohibited from separately collecting taxes facilitated by Tammj.

Commitments

You agree to use your Tammj Account and the Services in compliance with these Terms, applicable laws, and policies.

Account Activity

You are responsible for all activity under your Tammj Account. Protect your password and notify Tammj of any unauthorized account access.

Content

• Tammj Content: You are granted a limited, revocable license to access Tammj’s content for personal, non-commercial use.
• User Content: By posting content (e.g., vehicle photos, reviews), you grant Tammj a worldwide, perpetual license to use, modify, and distribute this content for marketing and promotional purposes.

Prohibited Activities

You agree not to engage in the following:

1. Legal Violations:

   • Breach laws, licensing requirements, or third-party rights.
   • Post false, defamatory, or misleading content.

2. Harming the Tammj Brand:

   • Unauthorized use of Tammj trademarks or imitating Tammj branding.

3. Misrepresentation:

   • Provide false information, impersonate others, or falsify affiliations.

4. Failure to Fulfill Commitments:

   • Failing to deliver or return vehicles on time.
   • Circumventing Tammj fees by transacting outside the platform.

5. User Harm:

   • Harassing or stalking other users.
   • Engaging in abusive or discriminatory behavior.

6. Unauthorized Use:

   • Contacting users for purposes unrelated to bookings.
   • Using bots or scraping data from the Services.

7. Service Interference:

   • Distributing malicious software or attempting to bypass security measures.

8. Circumventing Suspensions:

   • Creating new accounts after suspension or listing vehicles tied to banned accounts.
